दो साल पहले जेएनयू कैंपस से ग़ायब हुए नजीब अहमद मामले में सीबीआई को क्लोज़र रिपोर्ट सौंपने की अनुमति देने के दिल्ली हाईकोर्ट के फ़ैसले पर नजीब की माँ फ़ातिमा नफ़ीस ने बेहद निराशा जताते हुए, इसे अन्याय बताया है। उन्होंने फ़ैसले के ख़िलाफ़ सुप्रीम कोर्ट का दरवाजा खटखटाने का ऐलान किया है।
नजीब 15 अक्टूबर 2016 से लापता है। आरोप है कि एक दिन पहले उसका एबीवीपी सदस्यों से झगड़ा हुआ था। लेकिन सीबीआई का कहना है कि उसे ऐसे झगड़े का कोई प्रमाण नहीं मिला जबकि फ़ातिमा नफ़ीस का कहना है कि सीबीआई ने एबीवीपी के किसी सदस्य से पूछताछ तक नही ंकी।
जस्टिस विनोद गोयल और जस्टिस एस.मुरलीधर की पीठ ने फ़ातिमा नफ़ीस की याचिका का मामला ख़त्म करते हुए कहा है कि वे स्थिति रिपोर्ट के लिए निचली अदालत जा सकती हैं। याचिका में नजीब का पता लगाने के लिए एसआईटी गठित करने का निर्देश देने की माँग की गई थी। फ़ातिमा नफ़स ने फ़ेसबुक पर लिखा-
नजीब अहमद की गुमशुदगी बड़ा मामला बना हुआ है। इस मुद्दे पर जेएनयू ही नहीं कई जगह बार-बार विरोध प्रदर्शन आयोजित किए गए जिसके बाद मामला सीबीआई को सौंपा गया। लेकिन उसने मामले को बंद करने की दलील दे दी।
इस मसले फ़ातिमा नफ़ीस की ओर से जारी एक प्रेस बयान में कहा गया है कि नजीब के लापता होने की जाँच में उच्चस्तरीय राजनीतिक हस्तक्षेप हुआ। न ही पुलिस और न सीबीआई ने एबीवीपी के उन सदस्यों से एक बार भी पूछताछ की जिनसे झगड़े के बाद नजीब लापता हुआ। यही नहीं, मीडिया के ज़रिए नजीब के आईएसआईएस में शामिल होने से लेकर सीरिया जाने तक की अफ़वाहें फैलाई गईं और जब इस मामले में मानहानि का मामला दायर किया गया तो पटियाला हाउस कोर्ट से मामले की फ़ाइल ही ग़ायब कर दी गई।
नजीब की माँ के मुताबिक वे इस फ़ैसले से बेहद आहत हैं। सीबीआई ने बेहद पक्षपात ढंग से मामले की जाँच की और उन्हें बचाने की कोशिश की जिन पर नजीब को ग़ायब करने का आरोप है। वे सुप्रीम कोर्ट से गुहार लगाएँगी। जेएनयू छात्रसंघ के नवनिर्वाचित अध्यक्ष ने एन.साई बालाजी ने कहा है कि मोदी राज में पुलिस और सीबीआई कठपुतलियाँ बनकर रह गई हैं। नजीब की लड़ाई को आगे बढ़ाया जाएगा।

It with greatest regret that we inform you that Fatima Nafees’ habeas corpus petition regarding her son Najeeb Ahmed has been disposed off by the Delhi High Court. *Our plea that the case be transferred to a Special Investigation Team (SIT) has been declined. This setback will not deter us from our struggle for justice for Najeeb. Fatima will challenge this order in the Supreme Court and we will rally in her support.*
The investigation in this case has shown the *blatant political interference at the highest levels and the extent to which institutions such as the Delhi Police and the CBI has been severely compromised under the Modi Government.* Despite repeated appeals and protests and strongest arguments made in the court, both the CBI and the Delhi Police has stubbornly refused to investigate into the assault against Najeeb the night before he disappeared. Najeeb’s assaulters who are all ABVP members have been represented at various points by the most expensive and high profile lawyers. Fatima Nafees’ case against the media groups and ABVP members for defaming her son, filed at the Patiala Court went missing from the court premises.
In these ways and more, Fatima Nafees’ brave and unstinting struggle to find her son has been thwarted at every instance. *Refusing to acknowledge the larger political interference, even the Delhi High Court has deeply disappointed Fatima Nafees and the JNU student community with this verdict.*
“I am heartbroken at this verdict. The CBI has conducted the most biased investigation and its sole objective has been to shield those who assaulted my son. I still retain faith in the judiciary and will not stop until I find justice for my son,” Fatima Nafees said after the hearing.
JNUSU President N. Sai Balaji said, “While we are deeply dejected with the verdict of the High Court, we are determined to carry this struggle forward. The CBI and the Delhi Police have become puppets under the Modi regime and it has been apparent in the way in which the investigation over the last two years have been severely compromised.”
